These Terms of Service ("Terms") govern your use of the Apex Heritage online store and any purchase you make through it. By placing an order you confirm that you have read and accepted these Terms. If you do not agree, please do not use the store. Nothing in these Terms limits your mandatory statutory rights as a consumer under EU and national law.

1. Who we are

Apex Heritage is a trading name of the Operator identified above. In these Terms "we", "us" and "our" mean the Operator; "you" means the customer.

2. Who may buy

You must be at least 18 years old and legally able to enter a binding contract. Products are offered for personal, non-commercial use unless we agree otherwise in writing.

3. Nature of our products — please read carefully

Apex Heritage sells collectibles and fan merchandise: scale die-cast models, display-only replica helmets, apparel, books and framed prints.

Replica helmets and scale models are collector display items only. They are NOT certified safety equipment and must never be worn or used for motorcycling, karting, motorsport, cycling or any protective purpose.
Unless a specific listing states otherwise in writing and with documented evidence, items are unofficial, tribute and fan-inspired products. They are not official, licensed by, endorsed by or affiliated with Formula 1, the FIA, FORMULA ONE companies, any Grand Prix, any team (including but not limited to Ferrari, Red Bull, Mercedes-AMG, McLaren and Aston Martin) or any driver.
All third-party names, team names, driver names, liveries, logos and trademarks referenced on the site belong to their respective owners and are used for descriptive/identification purposes only.
Photographs are illustrative. Colours, finishes and packaging of scale models may differ slightly from images. "Signed", "autographed", "certified provenance" or "certificate of authenticity" claims apply only where the individual listing expressly says so and supplies the relevant documentation.

4. Prices and currency

All prices are shown in euro (EUR) and, for consumers, are inclusive of applicable VAT . Delivery charges, and any import duties or taxes that may apply to cross-border shipments (see Shipping Policy), are shown separately before you confirm your order. Any "was" / reference price shown next to a reduced price reflects the lowest price we applied in the 30 days before the reduction, in line with EU price-indication rules.

5. How a contract is formed

Displaying products is an invitation to order, not a binding offer. When you place an order you make an offer to buy. We will send an order acknowledgement by email; this confirms receipt but does not conclude the contract. The contract is formed when we send you a dispatch/confirmation email for the relevant item. If we cannot accept your order (for example, an item is unavailable, a price was clearly mis-stated, or fraud is suspected), we will tell you and refund any payment taken.

6. Payment

Payment is taken through our third-party payment provider . We do not store full card details. You warrant that you are authorised to use the payment method.

7. Delivery

Delivery times, costs, dispatch handling and customs/import information are set out in our Shipping & Delivery Policy, which forms part of these Terms. Risk in the goods passes to you on delivery.

8. Right of withdrawal (14 days)

As an EU consumer you have the right to withdraw from a distance purchase within 14 days without giving a reason, subject to legal exceptions. Full details and the model withdrawal form are in our Returns & Refunds Policy, which forms part of these Terms.

9. Legal guarantee of conformity

We are under a legal duty to supply goods that conform to the contract. As an EU consumer you are entitled to the statutory guarantee of conformity (a minimum of 2 years from delivery) at no cost, in addition to and independent of the right of withdrawal. If an item is faulty, not as described, or does not have the qualities you can reasonably expect, you may be entitled to repair, replacement, a price reduction or a refund. 10. Availability and sourcing

Many items are made to order or shipped directly from our suppliers. We are the seller and remain your point of contact for the whole order, including delivery and after-sales, regardless of who dispatches the goods.

11. Intellectual property of this site

The Apex Heritage name, store design, original text and original imagery are owned by or licensed to us and may not be copied without permission. This clause does not grant us any rights in third-party marks referenced under clause 3.

12. Acceptable use

You agree not to misuse the site, submit false orders, attempt to gain unauthorised access, or use the store for unlawful purposes.

13. Our liability

We do not exclude or limit liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, for fraud, or for your mandatory statutory rights. Subject to that, we are not liable for losses that were not reasonably foreseeable or that arise from your misuse of a product (for example, using a display-only replica as protective equipment). Our total liability for a contract will not exceed the price paid for the relevant goods, except where the law provides otherwise.

14. Complaints and dispute resolution

Please send complaints to support@70yearsf1.com ; we aim to acknowledge withinworking days. If we cannot resolve a dispute, you may be entitled to use an alternative dispute resolution (ADR) body in your country. (Note: the EU Online Dispute Resolution platform was discontinued on 20 July 2025; we therefore refer consumers to national ADR bodies.) Nothing here affects your right to bring proceedings before the competent courts.

15. Governing law

These Terms are governed by the law of the Netherlands . If you are a consumer resident in another EU/EEA country, you keep the protection of the mandatory consumer-law provisions of your country of residence, and you may bring proceedings in the courts of that country.

16. Changes

We may update these Terms. The version in force when you place an order applies to that order. Material changes will be posted on this page with a new "last updated" date.
